LAST WILL AND TESTAMENT OF JOHN NICHOLS of Bedford, Va, 1803

Will of John Nichols, dated 5 April 1803
" In the Name of God Amen I John Nichols Sen. of Bedford County in the State of Virginia being low in health and weak in body but of perfect mind & memory, thanks to Almighty God, but knowing it is allotted for mortal man to die, I do make and ordain this to be my last Will and Testament, first recommending my poor Soul into the hands of the almighty God that gave it to me and my poor body to decently to interred and after my lawful Debts and funeral expenses is discharged, I will and bequeath my Worldly Estate that it hath pleased the Almight God to possess me with, in form and manner following, Viz Item, I bequeath unto my son Flayl Nichols my big family Bible. Item , I bequeath to my son John Nichols, my young horse called Ceilia, after my beloved wife, Martha, decease. Item; I bequeath unto my son Archibald Nichols, a tract or parcel of land beginning at a locus near the fence of premises now tending, thence a new marked line down to the mouth of ny lane, thence along the old line to Gills and my corner tree to a spanish Oak, thence along as the old line directs to a chestnut or Burnetts line, thence along Burnetts line to a newmade corner white Oak on Elisha Nichols line thence along Elisha's new line to the first station. Item; I bequeath unto my son Elisha Nichols a tract of land or parcel of land, beginning at a chestnut on Ayer's road thence along the road as the new mark line goes to a pealed corner white oak , thence off across the field and as the newmarked line goes to a corner white oak on Burnetts line including the twelve Acres I purchased of Elisha Burnett, thence along the line to the beginning station. Item ; I bequeath unto my son Jesse Nichols, the tract or parcel of land whereon I now dwell after my beloved wife Martha Nichols (decease) Beginning at Pointers next to John Hall's line, thence along as the line directs to a corner chestnut on Ayers road thence along the road a new lineto the corner pealed white oak in the field, thence along off across the field and along Elisha's new mark't line to the new mark't corner locus by the fence, thence along the new mark't line to the mouth of the lane, then along as the old line directs to Gill's and my corner Spanish Oak. Item ; I bequeath to my beloved wife Martha Nichols, the negroe Wench name Delphia and negroe boy named Frank, during her life or widowhood, after that to be equally divided between by my two sons Elisha and Jesse Nichols. Item; I bequeath unto my sons Elisha and Jesse Nichols the waggon, three horses, named Dick, Jack and Sawny, and all the utensils belonging to the waggon. Item ; I bequeath unto my son Elisha one red and white spotted no horn Heifer. Item ; I bequeath unto my son Jesse Nichols one dark brinded Heifer. Item; I bequeath unto my children Mary Cundiff, John Nichols, Katherine Pollard, my son Archibald Nichols, and my daughter Jane Hancock, all the other moveable property of my Estate after my beloved wife Martha Nichols deceases excepting what is before mentioned and a small shott gun, which I bequeath unto my grandson John Nichols, the son of my son John Nichols., Item; I do constitute and ordain my two beloved sons Elisha Nichols and Jesse Nichols my sole Executors to this my last Will & Testament revoking and disannulling any other former Will & Testament and constituting and allowing this to be the last Will & Testant according to my desire; Given under my hand and seal this 5th day of April 1803.

BOURN TO BREAK WALLS

When I first started researching my Bourne line I did not get very far. My great grandma Vennie Lee Bourne was the daughter of James Emmett Bourne and Amelia Vaughan. His father was named James and his mother was named Matilda C Stephenson and they were my brick wall for a long time.

While Amelia's marriage record named Emmett's parents as Jas and M, there were no real clues to their identities. Did M stand for Mary or Marilyn or Mariah? Why dont people fill these things out better? Obviously Jas stood for James but where was he from? When was he born?   

James and M were probably in Wythe County around 1901 right? So thats something. Ancestry would not help either. Not a clue for a long time... 

Then one day, Emmett's Death Record popped up revealing that M was actually Matilda and his wife was Pamelia....

So James Sr was also an E and Matilda may be a Stevens instead of a Stevenson... 
Emmett was 83 when he died in Fries and his birth and death dates were in the record.  
Once I had this info Matilda Bourn got a hint.... 

In the 1900 census, Matilda is a widow,... living in Wythe with her kids...

Now we can see that Matilda was born in 1861 Virginia, and so there is a good chance James E was too....      

Also she may have had Geary (George) when she was eleven???  Well, you know how women are about their age... or it could just be a typo. What do they call typos in long hand???  Oh right, census takers.  

1880 Census shows James Bourn at age 79 and wife Matilda at age 28... about 51 years apart... and that puts James Sr. at a birth date around 1801.... so Matilda may be a second wife... and his son James Emmett was born when he was about 80... wow....   

Matilda and James were married when she was 27 according to her marriage record.....

James parents turned out to be Steven Bourn and Rosamond H Mallory Bourn... 

I have to thank a cousin for this revelation as there were no hints to connect the dots here.... 

"How did you link James E Bourne (before 1860-1900) and Matilda Stephenson as being the parents of William James Emmet and the others? According to the trees on ancestry and rootsweb members connect this James E Bourne was born about 1800 in Grayson County.

The information above has the parents of James E Bourne as Stephen Devil Bourne (b. 31 Oct 1760 in Louisa Co VA) and Rosamond Mallory (b. 4 Sep 1792.)
They have James as being born 16 Sep 1800 in Grayson Co. VA and his wife Matilda Stephenson as much younger.

I Catharine Pollard (formerly Catharine Nichols) daughter and one of the heirs at law of John Nichols deceased do upon oath testify and declare to the best of my knowledge and belief that John Nichols did enlist in 1778 for the term of during the war and served in Regiment Number six, under the command of Colonel [Mordecai] Buckner of the Virginia continental line, and that he continued in the service aforesaid until the close of the war. I further declare that I have never received from the United States a warrant for the bounty land promised to the said John Nichols on the part of the United States, nor do I believe that he ever received it, or transfered his claim to it in any manner whatsoever, Therefore Know all men by these presents, that I Catharine Pollard aforesaid do hereby constitute and appoint Leroy Jordan to be my true and lawful attorney for me and in my name, to demand and receive from the Secretary of War of the United States, a warrant for the quantity of land due to me as aforesaid, and my said attorney is hereby fully authorized & empowered to constitute and appoint one or more attorneys under him for the special purposes above expressed.

Catharine Pollard of lawful age being duly sworn says, that she has never received from the State of Virginia any bounty land on account of services rendered by her father John Nichols who was a soldier of the 6th regiment of the Virginia line on continental establishment during the revolutionary war, neither has any other person or persons claiming as heirs to the said John Nichols so far as this deponent knows or believes, neither did the said John Nichols ever receive it during his lifetime to the knowledge of this deponent. neither has this deponent ever sold, assigned or in any was disposed of her claim and further saith not [1 June 1830]

FLAYLE PAYNE OF FREDERICK COUNTY

"Martha Payne, daughter of Flayle Payne, married John Nichols of Frederick County, MD, probably in the 1750s. In 1757 or 1758 Sgt. John Nichols was credited for six days service in Capt. Moses Champlaine's Company during the French and Indian Wars. In March 1776 Lt. John Nichols was among the men who subscribed to and enrolled in Capt. Henry Boteler's Company of Frederick County Militia.Other enrollees were Sgts. Archibald and William Nicholls (sic), Flail Payne (sic), Barton Philpott, and John and Barton Garrett were among the men who took the Oath of Fidelity and Support in Frederick County."

MY 6TH GREAT GRANDFATHER THROUGH HIS DAUGHTER MARTHA NICHOLS.  

PAYNE, Flayle Payne Sr. (1696-1764) Biography

Flayle Payne was Christened 29 Nov. 1696, St. Mary Magdalene Anglican Church, Old Fish St. in London England. His parents were Thomas and Elizabeth Payne. 

Thomas Payne was listed as a Clothworker in the 1695 census of London. The Clothworker's union were a powerful organization that played a big part in the government of London. King James was an honorary member of the Clothworkers. Thomas and Elizabeth Payne had three sons and a daughter, all Christened in St. Mary Magdalene Anglican Church in London. 

Mary was Christened on Mar. 10, 1693 
Flayle was Christened on Nov. 29, 1696.
John was Christened on Oct. 27, 1702.
Thomas was Christened on Oct. 1, 1704.

Flayle Payne first appeared on record in America as a witness in a Prince George's Co. Maryland court in August 1727. In Nov. 1730, Flayle Payne was listed on a list of settlers in the Monocacy Valley of western Maryland. Also, in 1730, Flayle was listed as an Indian Scout in Prince George's Co. In July 1731, the Maryland Assembly rewarded Flayle Payne for returning a runaway slave from beyond the Monocacy. In 1734, 1736, and 1737 Flayle was paid a small bounty for bringing squirrel heads in to Prince George's County.  

In Nov. 1738, Flayle was appointed overseer of the road built between Monocacy and Antietam. In Nov. 1740, Flayle was appointed Constable of Monocacy Lower Hundred.

The English Church was established in Maryland in 1692, and in 1742, Frail Pain (Flayle Payne) was among the inhabitants, of Senaca and Monocacy Hundreds, who signed a petition to divide Prince George's Parish and establish All Saints Parish. However, Flayle's name never appeared on any church records. 

In 1744, Flayle Payne, and son, Thomas, signed a petition for a bridge to be laid out at the mouth of Catoctin Creek and a main road to be laid out from Tuscarora Creek to the mouth of Catoctin and from thence to Antietam Creek in present day Washington County. 

In 1748 Frederick Co. was formed from the western part of Prince George's Co. In a Nov. 1750 court, Flayle Payne and Flayle Payne Jr. were among the gentlemen appointed overseer of the River road and Richard Touchstone's Road.

Will of Flayll Payn dated October 1764 
He devised "Payn's Industry" to son Thomas, the upper part of "Payn's Delight" to son John, and the lower part to sons Flayll and Peter, equally. He bequeathed one-third of his moveables to son Flayl, and the balance of the moveables to be divided between Peter and John Best. He bequeathed one shilling sterling to daughter Martha Nichols.

In the above will, no wife was named. We think that John Best was married to a deceased daughter of Flayle. Flayle's land, " Payne's Delight" was located approximately where the present day town of Knoxville Maryland is today, near the Potomac River. "Payne's Industry" was located in the vicinity of the present day towns of Weaverton and Sandy Hook.  

Of Flayle's children, Thomas died shortly after his father. Some of his descendants migrated to Bedford Co. Virginia during a period from 1773 to 1779.

 Frederick Lee Payne, now deceased, from Cincinnati Ohio, descends from Thomas. Fred's lineage is Flayle Payne, Thomas Payne, Flayle Payne, who migrated to Bedford Co. Va., Flayle Pollard Payne, of Bedford Co. and Giles Co. Va. Thomas Payne, Fred Pollard Payne, and Frederick Lee Payne. I have a DNA match with Frederick Lee Payne. 

Norman L. Payne author of " Payne and Associated Families of Breckinridge County Kentucky" descends from Thomas Payne, but, for some reason, his DNA does not match others in the Flayle Payne line, maybe an adoption?

John Payne, son of Flayle, from whom I, Billy Payne descends, sold his portion of "Payne's Delight" in 1773, and along with wife, Mary, purchased 112 acres of land in south Bedford Co. Va., near Huddleston Va. in 1774. It states "John Payne late of the Province of Maryland" The land was located on the branches of Rock Castle Creek. He later purchased 120 acres of land on nearby Goose Creek. In 1781 John Payne was credited with providing one beef for the Revolutionary cause and was declared a Patriot. I, Billy Payne, have a DNA match with Thomas Chester Payne of Bedford co. Va. 

His family lived on a portion of the land that John and Mary Payne purchased in 1774. The above John Payne died in Bedford co. in 1798, leaving a will naming wife, Mary, sons John, Thomas, and William, and daughters Catherine Kennett, Sarah Brown, and Margery Harper. 

Flayle Payne Jr., son of Flayle, operated a ferry that crossed the Potomac between Maryland and Virginia in the 1760's. He was also a private in the American Revolution. He, accompanied by Patrick Lynch, moved to Bedford Co. Va., in 1779, and settled within a mile of his brother, John. 

Flayle Payne Jr. died in Bedford Co. in 1783, leaving a will naming sons, Thomas and William, and daughters Martha and Nancy. Peter Payne, son of Flayle, and wife, Elizabeth, by deed dated 27 April 1772, sold his lower half of "Payne's Delight" to his brother, Flayle Payne Jr. of Frederick Co.

 In 1766, Peter Payne, with other Planters of Frederick Co., signed a petition to the Council of Maryland requesting greater assurance of bills of credit. The will of Peter Payne was dated Nov. 1777, and probated 23 June 1778.
